The Risks of Clicking 'I Agree,' Firm Welcomes New Lawyer and More

 
Managing Partner Gary Lesser recently joined Stefany Valederrama in the CBS 12 News studio to talk about the risks we take by just simply clicking 'I agree' and not reading the Terms of Service just so we can get to watching a show on a streaming service or use an app or read an article online.

The conversation stems from news of a New York doctor who suffered a fatal allergic reaction after eating at a restaurant in Disney Springs. A wrongful death lawsuit was filed, however, lawyers for the Disney corporation tried to have it thrown out, arguing that the victim's husband waived all rights to sue Disney when he signed up for Disney+ account. Disney lawyers have since withdrawn the motion.

Gary spoke about the use of the word 'household' in the Terms of Service agreements, what a 'household' actually is and gave some important advice about how to be a better consumer in the digital age.

$900K Settlement for Client who tripped over improperly installed dishwasher
NEW CASE RESULT $900,000
More than six months after his new dishwasher was installed, Leonard Projansky tripped over the bottom of it and fell. He broke both femurs, which resulted in surgery, a week in the hospital and three months in rehab.

This was a complicated case for many reasons, but Firm Partner Joe Landy vigorously litigated the claim which resulted in a $900,000 settlement for our 82‑year‑old client.

Our client bought the dishwasher online from a wholesale club, and the purchase included delivery and installation. Unbeknownst to him, the wholesale club subbed out the delivery and installation to another company, which subbed it to another company which subbed it to another company. Joe had to file another lawsuit just to identify the proper companies to sue in the injury case.

For many, Sept. 8 was all about the start of the NFL season. The real big event of the day, however, was the season opener for High-5 Basketball!

Lesser, Lesser, Landy & Smith is proud to have sponsored the program for the last two decades!

High-5 Basketball is a division of the Boca Hoops Recreation Basketball Program and designed to enable children with disabilities to participate in the game of basketball. Along with a B-Ball Buddy, each athlete learns the skills of basketball along with the importance of sportsmanship and teamwork.
